Check-in and Check-out Times: Normal check-In time is from 3:00 PM and normal Check-out time is by 11:00 AM.
Early Check-in and/or Late Check-out: Early check in and/or late check out will depend on whether guests are leaving on your arrival day, or arriving on your departure day (making those days changeover days). If early check in is available, the earliest check in time is from 8AM. The latest check out is 10PM. If a late check out is available, a check out after 4PM will attract a TTD $400 late check out charge. We cannot guarantee early check-in or late check-out, as we can get last minute bookings. Please ensure that you ask for confirmation 1 or 2 weeks before coming to Tobago whether an early check-in or late check- out is available.
Restrictions: These are non-smoking villas. Smoking is only permitted on the porch and in outdoor areas. Large or formal sit-down events are not allowed (e.g. wedding receptions, birthday parties etc.). Informal or casual get-togethers (“limes”) are limited to 20 persons, inclusive of in-house guests. If considering an event, you should ensure that you request and receive advance approval for your event. Events requiring paid admission are not allowed. Pets are not allowed without prior permission, and may require an additional deposit if approved. Advance permission is required if the guest(s) wish to bring a pet, and if granted, special conditions may apply.
Reservation Deposit, Rental Payment and Security Deposit: To book, a deposit of 1 night's rate is required. The reservation payment is due immediately at booking.The full rental payment is due 1 month before arrival. If the guest(s) requested dates are less than 30 days the full rental payment plus the security deposit is due immediately upon booking. The reservation payment is not applied towards the rent and becomes the refundable security deposit when the guest(s) arrive. It will usually be refunded within 1 week after you leave, less any applicable damage deductions.
Cancellations: Cancellations will incur a penalty based on the criteria below:
Notice period before arrival is more than 30 days > Cancellation penalty = No penalty applied
Notice period before arrival is between 14-30 days > Cancellation penalty = 50 % of rental cost
Notice period before arrival is less than 14 days > Cancellation penalty = 100 % of rental cost
A Cancellation Penalty can apply if the booking is cancelled before arrival. If the Rental Payment was not made 30 days before the arrival date, the Cancellation Penalty will be deducted from the Reservation Payment.
If the Rental Payment had been made before the cancellation notice, the Reservation Payment will be refunded 100%, the Cancellation Penalty will be deducted from the Rental Payment, and the difference refunded.
If a confirmed booking is cancelled and the Cancellation Penalty was charged, but the villa was subsequently re-booked for the same time period by- other guests, the Cancellation Penalty (if taken) will be refunded.
Early Departure: After arrival, check-out before the contracted departure date can result in forfeiture of the rent for the remaining contracted days.
Maximum Occupancy: The maximum occupancy for our villas are 12 persons (including children over 3 years old). The guest(s) must inform the owner if a different number of guests will be staying at the villa, as your rate will change. If the number of guests staying at the villa varies during the entire booking period, the rental rate will be based on the highest number that stays during the entire period. If the number of guests staying at the villa exceeds the contracted number without prior approval and pre-payment, the guest(s) can be asked to leave the villa, and the unused balance of the Rental Payment can be forfeited.
Unacceptable Behaviour: The guest(s) agree not to create or allow to be created, either by the guest(s), any other member of the rental group, or other invited visitors, any disturbance at the villa or premises or within Samaan Grove or Silver Palms compound, which would be a nuisance to the owners or occupiers of other villas. This includes loud music, excessively loud outdoor conversations especially after 10PM, coarse or inappropriate language, parking or behaving in such a manner as to interfere with or disturb other residents. The use or consumption of illegal substances is strictly prohibited at the villa. The guest(s) accept full personal responsibility for any inappropriate behavior, disturbances, or losses or damage caused by any member of their rental party or invited visitors, whether on the premises or within the Samaan Grove or Silver Palms compound. The guest(s) agree to comply with requests from the owner or owner’s representatives when they are responding to complaints from other residents regarding any such activities at the villa or within the compound.
Unauthorized Removal of items from the villa: The guest(s) agree not to remove any items from the villa (e.g. furniture, appliances, bed and bath linen, furnishings, kitchen items, etc.) without prior authorization (beach towels and cooler excepted; they can be taken to the beach). The guest(s) will be charged for the cost of replacement of any missing items, and can be reported to the relevant authorities if appropriate.
Damage to Villa or Contents or other properties: The guest(s) agree to accept financial responsibility for all losses or damage to the villa or its contents, or damage caused to other properties by guest(s), any member of the guest(s) group, or invited visitors, except due to normal wear and tear. If the Security Deposit does not cover the full cost of the losses or damage, guest(s) agree to cover all excess costs.
Plumbing Blockage: The guest(s) agree to accept financial responsibility for any costs or losses as a consequence of blockages in the sewerage system due to foreign matter (e.g.. tampons, sanitary pads, diapers or flushable wipes) flushed down the toilets during your stay at the villa.
Condition of Premises at Departure: The guest(s) agree to leave the premises in reasonable condition at departure. If the premises are left excessively soiled or messy at departure, we may assess a cleaning surcharge of TTD $200 (USD $35) and deduct this from your Security Deposit. Examples include but are not limited to: unwashed cookware, dinnerware, glassware, cutlery and crockery; bottles, glasses in the kitchen and elsewhere; leftover food and kitchen garbage not bagged or placed in the garbage bin; and garbage (eg. cigarette butts, bottle caps, empty bottles, bones) thrown in the plant beds or on the lawn.
Limitation of Liability: The guest(s) agree to ensure the proper supervision of all members of the rental group or invited visitors (especially children) while in occupancy of the villa, and especially in or around the swimming pool. The owners or representatives of the villa will not be responsible for any accidents, losses, costs, or injuries incurred by you or other guests at the villa or the premises.
Factors Outside of Owner’s Control: We cannot accept responsibility for service disruptions outside of our control, especially Water, Electricity, TV and Internet services. If there is an appliance failure e.g., air conditioner, refrigerator, washer or drier, we will make every effort to have the problem resolved in the shortest possible time, but please understand that repairs may not be immediately possible depending on the availability of service technicians or repair parts. Depending on the issue, we will do our best to minimize any inconvenience you may experience as a result of the issue, but these kinds of failures will not be considered grounds for total rental refunds.
Renters’ Rights: Guest(s) who have paid the Rental Charge and are in compliance with their obligations as stated in this agreement, will be entitled to enjoy the use of the villa and premises without interruption or interference by the owners or owners’ representatives, except where urgent remedial repair work might be required.
Exceptions: Any exceptions to the above mentioned points must be agreed in writing in advance by the owner. If you violate the terms of this agreement, you can be asked to leave the villa, and the unused balance of the rental payment can be forfeited.
By signing the rental agreement, or by making the reservation/rental payments and staying at the villa, you have shown that you agree to be bound by the terms and conditions of this agreement.
